1.Detecting Suspicious Activity
All employees in client-facing or transaction-processing roles are required to complete annual AML certification. Failure to identify and report suspicious activity exposes the firm to regulatory sanctions, criminal liability under the Bank Secrecy Act, and reputational damage that can take years to repair.
Common red flags include unusually large cash deposits inconsistent with the client's stated occupation, rapid movement of funds between unrelated accounts, structuring transactions just below reporting thresholds, and reluctance to provide standard KYC documentation. Each pattern must be escalated to the MLRO within 24 hours of detection.
Suspicious Activity Reports (SARs) must be filed within 30 days of initial detection. The filing window cannot be extended without written authorization from the Chief Compliance Officer. Do not notify the customer that a SAR has been filed: tipping off is a separate criminal offence under both UK and EU law.
Individual employees may be held personally liable for failures to report. Under the Sixth Anti-Money Laundering Directive, individuals can face up to four years imprisonment for negligent non-compliance. Annual certification confirms you have read, understood, and will apply these procedures.
